What is the Plevin Ruling?
The phrase ‘Plevin’ refers to Mrs Susan Plevin. In 2014, she brought a PPI case to Paragon Personal Finance. She argued that she was mis-sold a PPI policy on a loan because of high levels of commission that was not disclosed to her at the time of purchase.
The secret commission is simply the commissions charged by the lenders and/or brokers on top of the actual PPI premium. So, in Mrs Plevin’s case, the premium was actually just over £1,600, yet she was charged just short of £4,000 and that premium cost was paid for through credit that she was paying the lender. The case went to the supreme court which ruled in Mrs Plevin’s favour.
What does it mean for me?
Plevin isn’t as well heard off as PPI. The Plevin ruling centres around unfair commission paid by customers on their PPI policies – something not considered previously.
This opens up new opportunities to revisit your PPI claim. If you’ve previously had a claim rejected, or your claim didn’t factor in the amount of commission paid you could now qualify under this new ruling.
You can make a claim under the Plevin ruling if:
- You’ve previously had a mis-sold PPI complaint rejected
- The commission the bank or lender received was not disclosed when you took out the policy
- You received a letter from the bank or lender in 2017 following the rejection of a PPI complaint
- You had a successful PPI claim, but you did not receive all the commission due
